1. Eligibility & User Accounts

To use the Service, you must be at least 16 years of age (or the minimum age of digital consent required in your jurisdiction, typically 13 with verified parental or legal guardian consent). By creating an account or using the Service, you represent and warrant that you satisfy these eligibility criteria and have the legal capacity to enter into this agreement.

When creating an account, you agree to provide true, accurate, current, and complete information and maintain the confidentiality of your login credentials. You are responsible for all activities that occur under your account. You agree to notify us immediately at support@skinlyst.ai upon learning of any unauthorized access.

2. Medical & Dermatological Disclaimer (Strict Non-Medical Use)

Never disregard professional medical advice, delay seeking medical counsel, or self-treat a medical condition because of information obtained through Skinlyst AI. If you experience skin irritation, persistent rashes, suspicious moles, allergic reactions, or dermatological symptoms, consult a qualified physician or board-certified dermatologist immediately.

3. In-App Subscriptions, Billing & Cancellations

Skinlyst AI offers free access tiers along with premium paid subscriptions (“Skinlyst Pro”) unlocking features such as unlimited skin scans, advanced ingredient safety decoding, and customized routine tracking.

• Billing via App Stores: Payment is processed directly through Apple App Store (In-App Purchases) or Google Play Store at confirmation of purchase, subject to their respective terms and payment methods.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle (e.g., monthly or annually) unless auto-renew is turned off or canceled at least 24 hours prior to the conclusion of the current subscription period.
• Free Trial Periods: Any unused portion of a free trial period will be forfeited when you purchase a subscription. To avoid being charged, you must cancel the trial at least 24 hours before it concludes.
• Managing & Canceling: You can manage, change, or cancel your subscription at any time via your Apple ID Subscriptions settings or Google Play Store Account settings. ZEALDS LLC cannot cancel subscriptions on your behalf.
• Refund Policy: All subscription charges and purchases are subject to the standard refund policies of Apple or Google. Refund requests must be submitted directly to the storefront provider.

4. User Content & Uploaded Photos

You retain full intellectual property ownership of the photos, selfies, skincare notes, and product scans you upload to the Service (“User Content”).

By uploading User Content, you grant ZEALDS LLC a limited, worldwide, non-exclusive, royalty-free license to use, host, store, and process your photos and data strictly for the purpose of operating, developing, and providing the Service to you (including executing AI vision analysis and generating routine recommendations). We never sell, rent, or publicly display your uploaded facial imagery to third parties.

You warrant that you own or possess the required rights to upload all User Content, and that your submissions do not infringe on the rights of any third party or violate any law.

5. Intellectual Property Rights

The Service, including its user interface, algorithms, visual designs, icons, logos, text, graphics, software code, and trademarks, is the exclusive proprietary property of ZEALDS LLC and its licensors. Subject to your compliance with these Terms, ZEALDS LLC grants you a personal, revocable, non-exclusive, non-transferable license to download and use the application on your personal device solely for non-commercial purposes.

6. Prohibited Activities

You agree not to:

• Reverse engineer, decompile, disassemble, or derive the source code or underlying algorithms of the Service;
• Use automated systems, scrapers, bots, or data harvesting scripts to access the Service;
• Interfere with, compromise, or disrupt the integrity or security of our infrastructure and networks;
• Upload malicious code, viruses, or harmful payloads;
• Attempt to use the Service to build a competing machine learning model or commercial skincare dataset.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, ZEALDS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR ACCURATE IN ITS ANALYSIS OF SPECIFIC SKIN TYPES OR CONDITIONS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZEALDS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR SKIN ADVERSE REACTIONS), REGARDLESS OF THE LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF FIFTY US DOLLARS ($50) OR THE AMOUNT YOU PAID TO ZEALDS LLC IN THE PRECEDING TWELVE (12) MONTHS.

9. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, or validity thereof shall be resolved through binding confidential arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.

10. Changes to Terms

We reserve the right to modify or replace these Terms at our discretion. If we make material modifications, we will notify you through the Service, via email, or by updating the effective date at the top of these Terms. Your continued use of the Service following any updates constitutes your acceptance of the revised Terms.
